New Legal Amendments

  1. Permits and Licenses:


    As of January 2024, landlords are required to obtain a permit from the Ministry of Culture and Tourism before concluding any rental contract for tourism purposes. The permit application must be submitted within one month of the start of the year, and the Ministry is required to issue the permit within three months.

  2. Short-Term Rentals:


    The new laws prohibit renting out properties for periods of less than 100 days without obtaining a special permit, with substantial fines of up to one million Turkish lira imposed for non-compliance.


Additional Requirements for Landlords

  1. Title Deed (Tapu):


    Landlords must provide tenants with a copy of the title deed (tapu), which proves ownership of the property and provides legal confirmation of its status.

  2. Numarataj (Municipal Numbering Document):


    Landlords are required to provide the numbering document issued by the municipality, which specifies the exact address of the property and ensures there are no disputes over its location.

  3. Earthquake Insurance (DASK):


    The law requires landlords to insure the property against earthquakes and to provide the insurance document (DASK) as part of the rental contract, to ensure the tenant is protected from damages caused by natural disasters.


Requirements for Notarizing Contracts for Foreigners

  1. Notarizing Annual Rental Contracts:


    The new laws require that annual rental contracts be notarized at the notary's office (the noter). This procedure requires both the landlord and the tenant to be present, along with verification of their identities and the submission of the necessary documents.

  2. Mandatory Presence of Both Parties:

    Rental contracts must be notarized in the presence of both parties, the tenant and the landlord, to confirm the validity of the signatures and prevent any illegal modifications to the contract without the knowledge of both parties.

  1. Working with Trusted Real Estate Agents:

    It is recommended to work with certified real estate agents to help foreigners understand the legal and regulatory requirements and ensure the contract is properly notarized.


  2. Checking the Condition of the Property:

    Before signing the contract, tenants should verify the condition of the property and its facilities, and ensure that all terms and conditions are stated in the contract to avoid any future disputes.


  3. Commitment to Paying Bills:

    Tenants are required to pay monthly bills such as water and electricity, as well as maintenance fees for shared facilities in residential complexes, and these costs must be clearly stated in the contract.


These amendments aim to improve the legal framework for rental contracts in Turkey and provide greater protection for resident foreigners. It is essential to follow the legal procedures and ensure that all required documents are notarized to guarantee a smooth, trouble-free rental experience.
